<p>I am opposed to “raiding,” for both legal and ethical reasons. My definition of “raiding” is targeting the existing representatives of a particular direct selling company for solicitation with an income opportunity of another direct selling company.</p>
<p>My recommendation to all company executives is – do not, at the company level, focus recruiting efforts at any one other company. Always treat your potential base of new recruits as being the entire United States, rather than any specific company’s organization of sales representatives. Further, do not encourage, permit, or even tolerate your representatives focusing their recruiting efforts at any one other company.</p>
<p>Raiding and violations of non-solicitation provisions are different, but often interrelated. When violations of non-solicitation provisions are focused on one other company, raiding is occurring. Non-solicitation provisions appear in most direct selling company independent representative agreements. In my opinion, such provisions are standard in the industry. Let us examine some of the business justifications behind these provisions.</p>
<p>Prohibiting the misuse of confidential information is paramount. The “misuse” most damaging to a company is any use resulting in or contributing to “raiding,” or specifically targeting the representatives of the company, enticing them to switch allegiance.</p>]]></content:encoded>

<p>Constant yakking and hard-sell tactics don’t create the positive buying emotions you want from your prospects, but the right vocabulary can.</p>
<p>Vocabulary is one of the great foundations to a natural, flowing presentation. The size and power of your vocabulary influences your ability to persuade. Surprisingly, research shows that the average person stops expanding his vocabulary at the age of 25. As a successful salesperson, you must be able to communicate effectively and powerfully through your vocabulary. If your language has been reduced to jargon and buzz words, here are some techniques that can get you started toward a more powerful vocabulary: 1. Keep a good dictionary and thesaurus. 2. Read books, magazines and newspapers voraciously. 3. Look up unfamiliar words and memorize their meanings. 4. Make an effort to use words whose meanings you know but rarely bring into conversation. 5. Look up all the synonyms of words you use regularly and start using these synonyms in conversation. 6. Take a course or read a book on expanding vocabulary. 7. Read “It Pays To Enrich Your Word Power” every month in Reader’s Digest.</p>
<p>Even if you only integrate one-third of those new words into your everyday language, it will reflect in your sales presentations. Remember, everything you say to a prospective buyer should lead to a closing. As you seek to become a master communicator, you must learn what words to use, when to use them, and how to use them effectively.</p>

<p>You didn’t make the ball team. You didn’t get accepted to your favorite college. You didn’t qualify for the home loan. These things do happen. Rejection is a fact of life. Successful people, however, know they need to embrace rejection instead of shy away from it.</p>
<p>The wealthiest and most successful people in society realize that rejection is a temporary setback, and they keep pushing forward. Other people allow rejection to overpower them and stop them in their tracks. They allow that negative feeling to take up permanent residence in their brain. But rejection doesn’t deserve to have that much power over you. Rejection exists only in your mind. It gets awarded power only when you allow it to enter your psyche, control you, and devastate your life.</p>
<p>Successful people face rejection over and over again. Henry Ford is a perfect example. By the turn of the 20th century, he had experienced two failing companies and lost the money of two different investment groups. But he didn’t give up. He located a third group of investors who gave him $28,000 to start a motor company. The “Model A” was born and Ford went on to make millions of dollars. Ford Motor Company became one of the most successful car manufacturers the world has ever known. Think how different Ford’s life would have been if he gave up after failing with his first company.</p>

<p>That is the great question this tax season. President Obama’s plan to help American taxpayers by withholding less tax from their paychecks may just backfire. For many taxpayers, especially low-to-moderate income taxpayers, those working more than one job could be surprised to find out that they owe money this year to good ole’ “Uncle Sam.”</p>
<p>When the plan was put into place to give taxpayers more take-home money, there was not a plan in place for those that are working more than one job, receiving a pension and working another job, two-income families and students that are claimed by a parent, to communicate with a unified system. So an example would be one system doesn’t know the other one gave the taxpayer a credit so, in fact, they will get two credits, one from each employer thus creating a new shortage.</p>
<p>Be smart, be tax wise. Knowing current changes in the tax law, tax credits and refunds is imperative for your financial stability. If you are not sure of “what’s new in the tax world,” work with a professional tax preparer, one that has your best interest in mind – not his or her pocketbook. The only time you should pay a contingent fee to a tax preparer, based on a percentage, could possibly be on an amended return or a payment negotiation or offer in compromise plan. All other times you should pay either a flat fee, based on your tax return and schedules, or an hourly rate.</p>

<p>A hero is someone who the moment prior to becoming one was a reckless, irresponsible dreamer. One is successful just in the sincere attempt to become successful.</p>
<p>I wrote the above while in deep reflection, mulling over whether I was truly prepared to take on the mammoth job of successfully launching an Internet marketing company. Having survived several start-ups of this magnitude, albeit not in the cyber-world, I knew this undertaking would be one that involved much more than just plain positive thinking.</p>
<p>However, as part of the process, I did return to my favorite “success” books, reading through them like familiar old friends. This time though, I experienced a new “awakening,” not from what I discovered in the books, but from what I found was sorely missing in most of them.</p>
<p>Please bear in mind that I believe with all my heart the last statement, however, for the sake of this article I will refer to “achieving success” as the actual attaining of one’s “goal of success.”</p>
<p>The majority of books and other motivational materials fail to address the piece of the proverbial puzzle that is most often the single determining factor between achieving success, or not. If this key element were included as such, the infinite collections of you-can-make-it resources wouldn’t be such an easy sell. The omitted “truth” would put the reality of achieving success in the cold hard light that it should be presented in.</p>
<p>This required ingredient has little to do with the stuff we should think, but has everything to do with the potentially high cost of “doing.”</p>

			<content:encoded><![CDATA[<p>It is surprising how often an MLM attorney is confronted by a well-meaning regulatory agency alleging that a certain multi-level client is in violation of their “pyramid scheme” statutes. The complaint: The marketing plans will inevitably lead (by some abstract or theoretical formula) to a total saturation of the given geographical area resulting in every single person in the area selling the company’s products. Therefore, they contend, there will consequently be no customers and no chance whatsoever for any of these sales people to earn commissions.</p>
<p>New Hampshire and Ohio still apparently entertain this outmoded and unrealistic notion and occasionally some authorities in California will refer to it.</p>
<p>This is the underlying rationale for the passage of pyramid scheme prohibitions in the first place – that they are inherently fraudulent because, by their nature, there will soon be no more possible participants and that, therefore, the scheme is doomed from the beginning. This is just not true. The whole underlying assumption on which pyramid scheme laws were passed was just plain wrong.</p>
<p>Not only has a total market saturation never occurred in the entire history of our industry, but the most prestigious court in the United States (except for the U.S. Supreme Court), the U.S. Court of Appeals for the Second Circuit located in New York, in a very entertaining and witty opinion, overruled the Federal Trade Commission (FTC) on this very contention.</p>

<p>I am opposed to “raiding,” for both legal and ethical reasons. My definition of “raiding” is targeting the existing representatives of a particular direct selling company for solicitation with an income opportunity of another direct selling company.</p>
<p>My recommendation to all company executives is – do not, at the company level, focus recruiting efforts at any one other company. Always treat your potential base of new recruits as being the entire United States, rather than any specific company’s organization of sales representatives. Further, do not encourage, permit, or even tolerate your representatives focusing their recruiting efforts at any one other company.</p>
<p>Raiding and violations of non-solicitation provisions are different, but often interrelated. When violations of non-solicitation provisions are focused on one other company, raiding is occurring. Non-solicitation provisions appear in most direct selling company independent representative agreements. In my opinion, such provisions are standard in the industry. Let us examine some of the business justifications behind these provisions.</p>
<p>Prohibiting the misuse of confidential information is paramount. The “misuse” most damaging to a company is any use resulting in or contributing to “raiding,” or specifically targeting the representatives of the company, enticing them to switch allegiance.</p>
